1. About these terms

These Terms of Service ("Terms") govern your use of the Find a Cost Lawyer platform operated at findacostslawyer.co.uk (the "Platform"). By registering for an account or submitting a request, you agree to these Terms.

The Platform is provided by Mackenzie Costs Limited, a company registered in England and Wales.

2. The Platform

Find a Cost Lawyer is a marketplace that allows customers (individuals and law firms seeking legal costs services) to submit requests and receive quotes from suppliers (qualified costs lawyers and costs professionals). We introduce customers and suppliers; any engagement that follows a quote is a direct contractual relationship between the customer and the supplier.

We do not provide legal services through the Platform itself and we are not a party to any retainer entered into between a customer and a supplier.

3. Accounts

You must provide accurate and up-to-date information when you register. You are responsible for keeping your password confidential and for all activity on your account.

Supplier accounts are subject to approval. We may decline to approve an applicant or suspend an existing account at our discretion, including where we have reason to doubt the applicant's qualifications, regulatory status or professional standing.

4. Requests and quotes

Customers are responsible for the accuracy of information included in a request. Suppliers are responsible for the accuracy of their quotes and any statements they make about their services, qualifications, insurance and regulatory status.

A quote does not create a retainer. A retainer is formed only when the customer and supplier agree separately on the scope of work and on terms of engagement.

5. Conduct

You agree not to use the Platform for any unlawful purpose, to misrepresent yourself, to submit sham requests or quotes, to contact other users for purposes unrelated to a live request, or to interfere with the operation of the Platform.

6. Intellectual property

The Platform, including its software, design, trademarks and content (other than user-submitted content), is owned by Mackenzie Costs Limited. You may not copy, modify or redistribute any part of the Platform without our prior written consent.

7. Liability

To the fullest extent permitted by law, we are not liable for the quality, accuracy, timeliness or outcome of any services provided by a supplier to a customer. Our total liability arising from use of the Platform is limited to any fees paid by you to us in the twelve months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

8. Changes to the Platform and these Terms

We may update the Platform and these Terms from time to time. Material changes will be notified to users through the Platform or by email. Continued use of the Platform after a change takes effect constitutes acceptance of the revised Terms.

9. Governing law

These Terms are governed by the laws of England and Wales, and any dispute arising in connection with them is subject to the exclusive jurisdiction of the courts of England and Wales.
